In
many of life situations, circumstances after a marriage
termination rarely remain the same. When this occurs, there are
occasions when it is necessary to seek a modification
of a marital agreement or standing court order relating to
family law issues.
Depending on the terms of the Original Court Order
in the Divorce or Dissolution, a request for a post judgment family law modification may
be possible and appropriate.
However, certain areas of the Final Divorce Decree
or Judgment Entry may not be modified, unless both
parties agree to a modification. For example,
provided that the original court order allows a
modification of spousal support, the
applicant may still be required to show that the
financial condition of a party has significantly
changed, and that a modification may be warranted.
Oftentimes the applicant may be required to show
that the condition warranting the modification was
not known or foreseeable at the time of the prior
court order.
Modification of child support is more common. Child
Support modifications are appropriate where child
support worksheet shows that support will increase
or decrease by at least ten (10%) percent with the
adjustment. That is, after computing the change in
earnings of both of the parties, and all other
proper adjustments, the bottom line owed per month
by the obligor changes 10% or more, a modification
may be warranted.

Child Support modifications are often
appropriate where child support worksheet shows
that support will increase or decrease by at
least ten (10%) percent with the adjustment;
Child Custody or Visitation Modifications:
A parent may make a request to change the
existing child custody or visitation court
orders is a significant change in circumstances
exist to warrant a modification of the current
child custody and visitation orders. However,
any modification must still be in the best
interest of the child or children;
