In a child custody dispute, either parent may be awarded custody depending upon the facts of the current situation, and what the court deems as what is in “the best interest of the child.”

In awarding custody to one parent over the other, the court will consider the factors as outline in the statutes.  The court will take all relevant and appropriate evidence into account in effort to make a determination of how the child's best interests will be served based upon the evidence presented to the court.  If a custody decision has already been made, the burden is often higher to overturn any previous decision.

Once the court makes their decision regarding the primary custody of the child (or children), they will issue a court order to allocate the parental rights and responsibilities for the care of the children, as well as the rights of  the parent which is issued visitation rights or parenting time.

These court orders may detail issues on the matter such as:

• What party the child or children will primarily reside with;

• Shared Parenting Plans, which will list each party’s parenting times, and describe each parties rights and obligations under the agreement;

• Order the amount of child support to be paid, and by whom to whom;

• And other specific issues which may be unique to the specific child custody or visitation situation.
